    These General Terms and Conditions apply to every offer made by SommelJane and to every distance contract concluded between SommelJane and the consumer. The terms are accessible to everyone and are included on our website www.sommeljane.nl Upon request, we are happy to send you a written copy. You can make this request by phone, post, or email.

    Article 2 – Online Sales
    For sales to consumers/businesses via the internet, the statutory rules for distance selling apply. SommelJane does not provide or sell alcoholic beverages to persons under 18 years of age. By ordering alcoholic beverages, the customer confirms with the placement of an order that they meet the legal minimum age for the purchase of these products. The customer undertakes the obligation that only he, or a person authorized by him who has also reached the legal minimum age of 18 years, will receive the order. Age verification is required upon delivery.

    Article 3 – Intellectual Property Rights
    The intellectual property rights concerning the SommelJane website, including the software, texts, images, and sounds, belong to SommelJane. Without SommelJane's permission, it is not permitted to disclose, reproduce, and/or edit the information provided on the SommelJane website other than for personal use.

    Article 4 – Price and Shipping Costs
    The prices mentioned in the product offer include VAT and include excise duties, taxes, customs duties, and other levies. The prices stated on the SommelJane website are binding, except for typographical errors and deviations due to synchronization errors. All prices are per bottle in euros. The prices exclude any delivery costs and any gift packaging. An overview of the current shipping costs can be requested from SommelJane.

    Article 5 – Payment
    Payments can be made via iDEAL, Visa, Mastercard, American Express, or Paypal.

    Article 6 – Delivery
    Delivery takes place at the address provided by the consumer to SommelJane. SommelJane will execute all accepted orders as quickly as possible, but no later than within 1 to 3 working days (Monday to Friday), unless otherwise agreed and excluding public holidays. In case of delay or incomplete execution of the order, the consumer will receive notification within 2 to 3 working days after placing the order. In that case, the consumer has the right to dissolve the agreement free of charge, after which SommelJane will immediately refund the amount paid. The risk of damage or loss of products lies with SommelJane until the moment of delivery to the consumer or a designated representative, unless otherwise agreed. Deliveries are carried out by SommelJane itself, via a carrier, or by courier service. The indicated delivery times are indicative, with SommelJane aiming for delivery within 1 to 3 working days. SommelJane is not liable for damages due to exceeding the delivery time.

    Article 7 – Liability
    SommelJane is not liable for amounts exceeding the invoice amount, or for an amount higher than the insurance of SommelJane can be held liable. Despite the permanent care and attention devoted by the authors and compilers to the composition of our website, SommelJane cannot in any way guarantee the accuracy or completeness of the information on the website. No rights can be derived from the content of the website. SommelJane accepts no liability whatsoever that may arise from the content of this website.

    Article 8 – Quality Guarantee
    The entrepreneur ensures that the wines comply with the agreement, the specifications stated in the offer, with the reasonable requirements of soundness and/or usability, and the legal provisions and/or government regulations existing on the date of the conclusion of the agreement.

    Article 9 – Retention of Title
    The delivered products remain the property of SommelJane until the customer has paid all outstanding debts to SommelJane.

    As long as all his payment obligations have not been fulfilled, the buyer may not transfer the contract goods to third parties other than in the context of the normal exercise of his business, nor pledge the contract goods to third parties as security.

    Article 10 – Jurisdiction
    All cases to which these General Terms and Conditions apply are governed by Dutch law. All disputes arising from an agreement between SommelJane and its customers will be submitted to the competent court.

    All judicial and extrajudicial costs that the seller reasonably has to incur to enforce compliance with these conditions and the agreement(s) to which these conditions refer, shall be borne by the buyer. Consumers are only liable for these costs after they have been urged to do so by the seller.
